2011-09-06 Reporting of near miss / hazardous occurences
Dear Masters,
We have to come back (see previous requests) to the requirement to report near miss / hazardous occurrences to the company (ISM Code 9):

9.1 The SMS should include procedures ensuring that non-conformities, accidents and hazardous situations are reported to the Company, investigated and analyzed with the objective of improving safety and pollution prevention.
9.2 The Company should establish procedures for the implementation of corrective action, including measures to prevent recurrence.

As we all (who worked on seagoing ships) know, near misses can and do happen several times every single day where people are working.
Luckily, most do not end in an accident ....
However, the ISM requirement is not properly implemented on board your ship, if we (Opielok) do not receive these reports from you!
Therefore, we require at 2 hazardous situation reports (M-0602, one from the engine- and one from deck department) per week by email to Opielok.
Please instruct your officers and crew to participate active in promoting the safety culture on board.
Please do not hesitate to ask me/us if you have any doubts.

2011-07-09 2011 Management review follow up
Dear Masters,
1.we all know that hazardous occurrences happen several times a day on board every ship; that's the reality and does not put you in a bad position. You need to report more of them to the opielok office! We will not blame anyone!
2.Accidents: for example – as soon as a seaman must be medically treated (medical log book)after burns or scratches or particles in the eye, you have to report an accident to the opielok office.
3.SOPEP: the SOPEP plan must be updated by the Master (type of ship, appendix 3/4, new company email address (@opielok.com). Record the changes in the table “Records of changes”.
4.SOPEP: next time a GL surveyor is on board, present the SOPEP to him to endorse/confirm the changes with a GL stamp (this way we do not need to re approve the complete SOPEP at the GL head office).
5.Work Permit forms: we can produce dozens of work permits if you like. Anyway, all jobs which are potential hazard to the crew and/or the environment –must- be covered by a RISK ASSESSMENT. I do not want you to fill up too many forms – I want you to use your brain, your experience and your sense of responsibility!
6.Safety Officer: we will separate the safety officer from the 2nd and 3rd mate. That means there will be a separate job description for the safety officer. Then, you can appoint the best suitable officer as Safety Officer.
7.3rd and 4th Engineer: please send me your proposal for job descriptions.
8.ECP: revision 3 (on CD) is updated with correct DPA/CSO and deputy DPA/CSO names
9.ECP: crewing company contact: I can add them, but it must be clearly understood that you have to report EVERYTHING to Opielok FIRST! .... Sometimes crewing items are only reported to the crewing company and the shipping company does not know about it.

The company decided to change the duties of the safety officer from the 2nd Mate to the 3rd Mate with immediate effect.
Pls appoint the 3rd Mate to the responsible person for all LSA and FSS on board your ship.
New Job descriptions attached.
PLs familiarize him with his new duties and make a familiarization record.
Pls make all crew members familiar with this change! Update the safety Muster list!
All forms/filing etc on the SMS will be changed by me asap.

2011-04-16 Certificate of moisture content and transportable moisture limit

Pls note the following:
Cargo information - mandatory requirement
Under the new SOLAS regulation VI/2.2.2 (Cargo Information), it is stated that information required on solid bulk cargoes has to be in accordance with section 4 of the International Maritime Solid Bulk Cargoes (IMSBC ) Code. One of the requirements is in the form of a certificate on the moisture content and its transportable moisture limit (TML) for cargoes that may liquefy and are listed in the IMSBC Code.
Certificate of moisture content and transportable moisture limit
The BIMCO Marine department has received enquiries as to whether there is a prescribed form for a certificate on the TML of an IMSBC Code cargo that may liquefy. Unlike the “Cargo Information Declaration Form” where a format has been provided in the IMSBC Code, no similar format is furnished for certificates relating to a cargo’s moisture content and its TML.
Notwithstanding that there is no prescribed form, Masters are advised that a certificate on the moisture content and the TML of a cargo that may liquefy, shall bear the following features:
1) Duly signed and dated;
2) Contain or accompany by the result of the test used for determining the TML; and
3) Declaration by shipper that the moisture content is, to the best of his knowledge and belief, the average moisture of the cargo at the time the declaration is presented to the master.
Test procedures and time limits
For Group A cargoes, i.e. cargoes that may liquefy, it is the appropriate authority or competent authority in the country of loading/origin that sets out the test procedure for determining the actual moisture content and TML of such cargoes. Methods for determining TML are given in Appendix 2 of the IMSBC Code; namely, the flow table test, penetration test and Proctor/Fagerberg test. The determination of TML shall be conducted within 6 months before the date of loading of cargo.
Sampling and testing of moisture content of a cargo shall be carried out no more than 7 days before commencement of actual loading. If there has been rain or snow between the time of testing and loading, further testing shall be conducted to ensure that the moisture content of the cargo is still below its certified TML. For various materials, there are recognized international and national methods for determining their moisture content. Masters should refer to sections 1.1.4.4 (Determination of Moisture content) of Appendix 2 and 4.6 (Sampling procedures for concentrate stockpiles) of the IMSBC Code for more details.
Carriage requirements for Group A cargoes
Masters are kindly reminded that in accordance with the IMSBC Code, a cargo that may may liquefy can only be accepted for loading when its actual moisture content is less than its certified TML; and a cargo having moisture content in excess of its TML ; it can only be carried in specially constructed cargo ships or specially fitted cargo ships.
